    Hi guys, so a couple weeks back I ordered dinner through a food delivery service. The food duly arrived but all three items were unsatisfactory to varying degrees and one was blatantly wrong. The following day I emailed the delivery service to complain. The response I got was that they would take it up with the restaurant but that they only deliver the food and took no responsibility for the quality. They said however that they would endeavour to get me a refund, so rather than tip up at them I let them have this opportunity. Today I've finally had an email back saying the restaurant doesn't want to know about it. The delivery service will refund my delivery fee. This isnt good enough imho and I'm sure contravenes my rights as a consumer. I'm positive the recipients of my payment should be the ones refunding me irrespective of whether they cooked the food or not. After all theyve clipped the ticket. They can call it a delivery fee but at the end of the day it's a margin on goods supplied. Interested in other opinions and especially those based on fact, before I decide whether to push this matter with the delivery service.

    I'll just add that yes, I feel for the delivery service as they can't control the quality of the food. But again, they make a margin across many deliveries (I've used them quite a bit myself) and should expect to have to cough up if the food isnt up to scratch and then take it up with their supplier. That's certainly how it works in my industry.

    can we merge this thread with the one where someone's wife abruptly fucked off and I'll tell you how I'm now in Australia after losing my house to the police mafia in Bangkok?

    Sorry Shark but someone had to get the "first world problems" thingee out of the way before we all dispense advice ranging from "hell yeah nail those sons of bitches and their sloppy service to the litigation wall" to "chill dude"

    all the while....

    said delivery company or the restaurant will continue not to give two fucks about your slightly cold food

    You can take it up with either of them under the Consumer Guarantees Act - the delivery service is effectively the retailer and the restaurant is effectively the manufacturer. Neither can abrogate their responsibility either - no buck-passing allowed.

    You can threaten either of them with the Disputes Tribunal, but probably a better threat is that you'll stop using them, particularly if you have a good history with either or both of them.

    @Godder am I right in thinking the disputes tribunal costs you and you can't add it onto your costs?

    @jegga Now you've put me in an awkward spot! No worries I'll take the risk of being chastised and will discuss something non-sport related with folk who I have been talking with for over a decade.

    Really good thanks mate, moved to Melbourne last week and as of 30 minutes ago landed a job in the field I've been wanting to get into for years. Housing investment was a bust as soon as that 40% deposit law came in so just used those savings to get myself set up across the ditch.
