@Kirwan Yeah. I would have thought that our laws are actually quite leniant, tolerant and protective, rather than harsh and severe as per the Greek Draco. US tort laws are far more Draconian and punitive.

Maybe he thinks it means old fashioned or something. I don't get it.

Or he's just another ignorant yank

I'm gonna take a stab that he knows about it, but doesnt know what it is, given he has done little leg work in terms of looking at the contract between the Cruise company and White Island tours (if there is one)

they've charged the helicopter company that flew in, landed and rescued badly injured people.

Can't see that endearing them to the public

@nzzp yeah I thought that was odd, but had they flown out there for tours as well?

Dont think Worksafe are particularly concerned about being liked, in fact many small businesses, particularly tradies already dislike them haha

They've charged Geo Service too I think. Worksafe will charge everyone if there is a death and see what sticks.

Yep, I imagine the wrecked helicopter still out there on the Island may be in the mix.

Yep, sounds like it's the work before the day that Worksafe are after.

As usual, the hot take is wrong. FAKE NEWS

So they didnt have Insurance? Which kicks in for the defence costs and any reparations (not fines)

That tells a bit of a different story to what I saw on the TB news piece on the two chopper guys last night and got bloody angry. I don't know all of the facts but apparently they saved 12 people and are now being prosecuted. I've been involved in SaR and whilst you don't want to add / be one of the dead you do what you can under dangerous circumstances. The prosecutions are for not taking precautions beforehand but the pilots actions afterwards are commendable. Tim Barrow and his dad (possibly uncle) Boyce have been around helis for ever. Boyce has written a book and I think has his picture in the AKL museum. They are not cowboys.

Both helis made it out, so maybe they had it right? Used good judgement? Some of what I heard is horrendous regarding the state the victims were in and those guys will live with it forever, but they did the right thing. Worksafe can fuck off. It is an active volcano why did they let them operate at all? It's their fault if they want to lay blame.

@Snowy it sounded like they tried to make them out as reckless cowboys rather than experienced pilots who made a call that saved lots of lives. Risky? Yes, but worth prosecution? Fuck no.

They didn't send the rescue helicopter and paramedics out, so it was dodgy, but those guys knew what they were doing.

isnt this about thier actions prior to the Eruption, rather the heroics after?

Worksafe have alot to answer for too though, one article I read was about one company wasnt registered as an adventure tourism company citing Worksafe as not being clear enough or being unsure...I know plenty of companies that do much less dangerous stuff and they must be registered, have hundred page H & S documents that need to be audited regularly.

I spoke to a guy recently who was starting a business in Queenstown (yep, there) and when he told me what he was doing, I said he would most likely need to be registered as Adventure tourism, but he said he contacted them and the person he spoke to thought he should be ok...I said you should still have a robust H & S plan, as if you are!

    This.

After Pike River there was that groundswell of discontent at no-one being charged or apparently held responsible for 29 deaths. So the Health and Safety Act 2015 emerged with a lot more teeth than its 1992 predecessor to change that, and now here we are.

It's been ironic listening to some MP's outraged at some of the charges.... conveniently forgetting they were part of the government (and in some cases in Cabinet) in 2015 who created and implemented the current Health and Safety Act.

I really enjoyed watching that last night. How that guy, who remained on the island and put the victims in comfortable positions, stayed so emotionless throughout the program, was quite remarkable.

I get that worksafe have a job to do but they are also a brand now and they need to make good decisions before going in hard against these two pilots.
