Jamie Padaharam from the Telegraph on Radio sport this morning who reported the ARU offered a 1+ million settlement which was turned down. With a better part of $4 million on the line Ezrail Fawlaow will roll the dice.
He also said there are further appeals to go so the first result is unlikely the end of the story.

Yep, a simple statement distancing themselves from Farlauwes views would have easily sufficed, the majority of people would not have cared. This is turning into a real mess for RA, it's very difficult to see them coming out in top especially if it goes to court.

After the last time, perhaps they didn't want to look weak? Either way, Folau seems to be quite happy to drag this into court

Even if they win, they lose. They're fucked because their head shed are awful. We all lose with them, of course.
Offering a settlement was the right way to go about it, otherwise they have to prove the "disrepute" bit which is far harder to handle.
Both sides lawyers know they won't get paid the full shebang unless they win.
Fans on both sides of the Folau divide are prepared to walk away.
It is such a tasty disaster, all because our talent development systems are rotten to the point where we throw $1M a year at a single bloke who can't pass or kick.

As paymasters surely the ARU should be seeking recompense from Folau for breaching the t's and c's of his contract - and for bringing the ARU and game into disrepute?
If for example, ordinary Joe Bloggs were to break t&c's of a contract of employment, they would be sacked immdeiately - no if or buts. And in today's climate, it wouldn't be unheard of to seek recompense from the former employee through the courts. -

@booboo Yes most certainly. ARU clearly stated in the new contract (one assumes) signed up to by both parties that he shouldn't use social media to push intolerance. Rugby is an inclusive game etc. For whatever reason, he clearly set out to break those terms, when he posted those comments several weeks ago, so why isnt he subject to the same rules and responsibilites as the rest of us? That is - he should be held accountable for his actions.
