The way I see it, if HRC loses, Comey will be seen to be a patriot by the Republicans. They'll have control of the senate, house and the SCOTUS meaning Comey likely escapes any kind of further scrutiny irrespective of the finding.

Smoking bullet? Love the mixed metaphor but I am none the wiser to what you are actually trying to say. You started off saying they found nothing.. that is obviously false. People being interested in this topic is perfectly rational and open minded. There was enough doubt in the original findings to cause questions when more details come to light. Clinton was not exonerated of all wrong doing.
What exactly do you think should be done by the FBI over this issue?
Seems to me the only close minded attitudes are those of people who think there is nothing to see.. despite it not being investigated yet.

Comey was farked either way here. He does nothing and this comes out after the election and he looks like he influenced the election or he does what he just did and still looks like he's influencing the election.
Clinton can only blame herself for this shitstorm. If she hadn't been so monumentally stupid in the first place then there would be no scandal and no FBI investigation.

@Baron-Silas-Greenback I think Comey should have stuck with their policies and traditions. He knew what he was doing was contrary to what was expected of the FBI / DoJ and he went ahead and did it anyway. Thats what makes the whole thing look really bad.
When you consider what the former AG has to say, it makes Comey look like a loose cannon:

That decision was incorrect. It violated long-standing Justice Department policies and tradition. And it ran counter to guidance that I put in place four years ago laying out the proper way to conduct investigations during an election season. According to the director himself, there is no indication yet that the “newly discovered” emails bear any significance at all. And yet, because of his decision to comment on this development before sufficient facts were known, the public has faced a torrent of conspiracy theories and misrepresentations.
This controversy has its roots in the director’s July decision to hold a news conference announcing his recommendation that the Justice Department bring no charges against Hillary Clinton. Instead of making a private recommendation to the attorney general — consistent with Justice Department policy — he chose to publicly share his professional recommendation, as well as his personal opinions, about the case. That was a stunning breach of protocol. It may set a dangerous precedent for future investigations. It was wrong."

@Frank If they already had something big they could have charged her. He announced that they were reopening the investigation because of the Weiner discovery. The timing is a terrible look. Even if Clinton wins I'd imagine she can still be charged or impeached if concrete evidence of wrongdoing is found

How can they have something huge on Hillary? They only just got the search warrant today.
As Holder explains, they have a policy not to take unnecessary action close to Election Day if it might influence an election's outcome.
Comey has acted contrary to their policies - at most institutions, thats a sackable offence.
The only way I see Comey holding onto his position is if Trump wins the election. -

That's why its is very unusual for him to go - right before the election "We MAY have something, MAYBE, we don't know, its not even from this case, but I think I should send an open letter to congress a week before the election"
You are acting like if she is voted in the FBI cannot then make a case against her. This isn't a dictatorship, she's not bulletproof Nov 9th.
Also, you & I had a discussion last week where you felt the Clinton machine had forced the FBI into not doing anything & that was a core reason she was unfit. My line was the opposite, Comey had actually not been gagged at all & had even over stepped his remit.

He can be asked to resign, and probably will be I suspect. If he says no it's likely that some Dem lawmakers will push for his prosecution under the Hatch Act, which would probably make his position untenable. If found guilty the AG would be able to dismiss him.

He may or may not have done it to influence the election (I'm not convinced he has), but if nothing comes of it the Obama administration followed by the Clinton administration will try to push him out (assuming Hillary wins)
